How Many Depo Provera Lawsuits Have Been Filed?

As of July 2025, at least 550 Depo shot lawsuits have been consolidated into a multidistrict litigation (MDL) in the Northern District of Florida. As of July 1, 2025, the MDL includes 435 pending cases, a significant jump from 348 just a month earlier.

Growth Statistics:

  • 550+ total cases in federal MDL

  • 25% increase in filings over 30 days

  • Additional cases are pending in state courts nationwide

What Brain Tumors Are Linked to Depo Provera?

The link between Depo-Provera and an increased risk of brain tumors, specifically intracranial meningiomas, has led to a number of lawsuits being filed against Pfizer Inc. Women who used Depo-Provera for longer than a year are over 5 times more likely to develop these tumors, according to The BMJ.

Medical Evidence:

  • 5x higher risk of meningioma brain tumors

  • Intracranial tumors requiring surgery

  • Long-term use significantly increases risk

When Will Depo Provera Cases Go to Trial?

Discovery on general causation wraps up in October, with expert challenges (Daubert motions) expected by early 2026. Judge Rodgers confirmed that bellwether trials are expected to begin in late 2026 or early 2027 to test liability and help guide settlement discussions.

Legal Timeline:

  • July 25, 2025: Federal preemption discovery closes

  • September 29, 2025: Oral arguments on Pfizer's dismissal motion

  • Late 2026/Early 2027: First bellwether trials expected

What Are Depo Provera Settlement Amounts Expected to Be?

Lawyers estimate that individual Depo-Provera Lawsuit settlement amounts could range between $100,000 and $500,000 or more, depending on individual circumstances. With other lawsuits involving meningiomas, settlements have averaged over $800,000, and trial verdicts have exceeded $3 million, according to the National Library of Medicine.

Settlement Factors:

  • Tumor severity and treatment required

  • Surgery complications and ongoing care needs

  • Lost wages and diminished earning capacity

  • Pain and suffering from neurological damage

Can Pfizer Dismiss All Depo Provera Lawsuits?

Pfizer is challenging the cases on federal preemption grounds. On September 29, 2025, Judge M. Casey Rodgers will hear oral arguments on Pfizer's federal preemption motion, which could, in theory, dismiss over 400 cases before they reach discovery.

Legal Challenge:

  • Federal preemption defense: Claims FDA rejected brain tumor warnings

  • High legal standard required for dismissal

  • September 2025 hearing will determine the outcome

With over 550 cases already filed and rapid growth continuing, the Depo-Provera litigation could become one of the largest pharmaceutical mass torts in recent years. The upcoming federal preemption hearing in September will be crucial in determining how these cases proceed. Women who used Depo-Provera for birth control and later developed brain tumors may have limited time to pursue legal action due to statutes of limitations.
